Documents Needed for Filing Bankruptcy

Please provide all of these documents. If we do not receive all documents, it will delay the filing of your case. We are required to disclose all information to the Court.

  • 2020, 2021, 2022 and 2023 TAX RETURNS. We need the Federal Form 1040, usually 1 or 2 pages. You will be notified later if the Arkansas form is needed. In the event you do not have the Form 1040, go online to IRS.gov and request the Tax Return Transcript. In the event you did not need to file a Tax Return, let us know and we will provide an Affidavit for you to attest to this.
  • PAYSTUBS for previous 6 months. We must disclose information for 6 COMPLETE months. In the event you did not work, let us know and we will provide an Affidavit for you to attest to this. For SSA, Disability and Pension income, please provide the statement stating the amount you receive
  • BANK STATEMENTS for Checking and Savings accounts. (ONLY IF REQUESTED BY TRUSTEE)
  • PAST DUE BILLS that do not appear on the credit report. Bills for household utilities are not necessary.
  • COPIES OF LOAN PAPERS of vehicles, home loans and other signature loans
  • PERSONAL PROPERTY ASSESSMENT AND REAL ESTATE PROPERTY ASSESSMENTS
  • 401K OR RETIREMENT ACCOUNT INFORMATION
  • VEHICLE INSURANCE proof of coverage. Usually, the card in your glovebox is sufficient. (MUST HAVE LIEN HOLDER ON POLICY.)
  • LIFE INSURANCE POLICIES that are not provided by your employer.
  • COPY OF DRIVER’S LICENSE AND SOCIAL SECURITY CARD

INFORMATION FROM WEBSITES

  • NADA VALUE of all vehicles. This can be obtained at nada.com.
  • CREDIT COUNSELING. Information to complete the course will be provided by the Firm.
  • Then later, once your case is filed and you obtain a case number, you will need to go online to www.decafnow.com and complete the SECOND, FINANCIAL MANAGEMENT, CLASS (also known as Debtor Education). The Attorney Code is BTX95599

FILING FEE AND ATTORNEY FEE

  • COURT FILING FEE. Cash Please, or else Money Order or Cashier Check Only.
    • For CHAPTER 13 $313.00 (Attorney fees are paid through the Plan).
    • For CHAPTER 7 $338.00 plus Attorney Fees, quoted once the attorney determines what is necessary for your case. Chapter 7 fees must be paid before the case is filed.
  • CREDIT REPORT. $45.00 for single filing, $90.00 for joint filing.
